Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Novari (“we”, “our”, “us”) governing your use of the Novari mobile application and the novari.fit website (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service.

2. Your account

You are responsible for the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@novari.fit if you believe your account has been compromised.

3. Acceptable use

You agree not to upload, generate, or share content that:

• Depicts a minor in any sexual or sexualized context.
• Is sexually explicit, pornographic, or contains nudity intended for sexual gratification.
• Depicts a real, identifiable person without their consent.
• Impersonates another person.
• Infringes anyone’s intellectual property, publicity, or privacy rights.
• Promotes violence, hatred, or illegal activity.
• Contains malware or attempts to compromise the Service.

We may remove content, restrict features, or terminate accounts that violate these rules. Repeated violations may result in permanent termination.

4. AI-generated content

Try-on outputs are generated by an AI model. They are previews, not photographs. They may differ from the actual appearance, fit, or color of a real garment on a real person.

5. Subscriptions and billing

Novari offers paid subscriptions (“Novari” and “Novari Pro”) and consumable credit packs through Apple’s StoreKit. By subscribing you agree that:

• Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Billing. Payment is charged to your Apple ID at confirmation of purchase.
• Cancellation. You can cancel any time in Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current period; previously paid amounts are not refunded.
• Credits. Consumable credits do not expire while your account is active and are not transferable.

Novari reserves the right to modify the Application or change subscription terms at any time. Any changes to subscription costs will be communicated before they take effect.

6. Refund Policy

Refunds for App Store purchases — both auto-renewing subscriptions and consumable credit packs — are handled by Apple under their standard policies. To request a refund:

• Visit reportaproblem.apple.com from any browser, or
• Open Settings → Apple ID → Media & Purchases → View Account → Purchase History on your device and tap Report a Problem next to the relevant purchase.

Approved refunds are processed by Apple, typically within 3–10 business days. Novari does not directly issue refunds for App Store purchases; we cannot reverse a charge on your behalf.

7. Account Deletion

You may delete your Novari account at any time from inside the app: open Profile → Settings → Delete Account and confirm. Deletion permanently removes your account, reference photos, try-on outputs, and saved looks. The deletion is immediate; encrypted backups may persist for up to 30 days as part of normal disaster-recovery before being overwritten.

If you cannot access the app, email admin@novari.fit from the address registered to your account with the subject “Delete my Novari account” and we will complete the deletion within 7 days.

Active App Store subscriptions are billed by Apple and are not cancelled automatically when you delete your Novari account. Cancel separately in Settings → Apple ID → Subscriptions on your device.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, who we share it with, and how long we keep it. By using the Service you acknowledge the Privacy Policy.

9. Intellectual Property

Novari’s name, logo, software, design, and content are owned by Novari and protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You retain ownership of photos and content you upload. By uploading them you grant Novari a worldwide, royalty-free, non-exclusive license to host, process, and transform them solely to operate the Service for you (including sending them to our AI processor to generate try-on results). We do not use your photos to train third-party AI models.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Novari is not a sizing, medical, dermatological, or styling advisory service. Try-on results are visual previews only and should not be relied on for medical, professional, or safety decisions.

11. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms or if required by law.

12. Changes

We may update these Terms from time to time. Material changes will be communicated in-app or by email and the “Effective” date above will be updated. Continued use of the Service after a change means you accept the revised Terms.
